WE CHARGE THE FOLLOWING FEES

When it comes to drafting of a Bill of Cost our office charges according to the Rules as set out in terms of Rule 8bis, 9 & 10 of the Appellate Division Rules,  Rule 48, 67, 68 & 70 of the High Court and Section 80 & 81 of the Magistrate’s Court Act and Rule 33, 34 & 35 of the Magistrate Court as well as Table A & B of Schedule 2 of the Rules.

Summary

  1. There are 3 types of Bills of Cost that can be drafted and they are as follows:
    • Party and Party Bill of Cost;
    • Attorney and Client Bill of Cost; and
    • Attorney and Own Client Bill of Cost
  1. The drawing fee according to Rule 70 of the High Court in the following Bills of Cost are:
    • Party and Party Bill of Cost = 11% drawing fee
    • Attorney and Client Bill of Cost = 11% drawing fee
    • DULY TAKE NOTE THAT with an attorney and client bill of cost a surcharge may be added to the bill of cost to the percentage of 25%.
  1. The attendance fee according to Rule 70 of the High Court in both the Party and Party as well as the Attorney and Client Bills of Cost are as follows:
    • 11% for the first R10 000.00;
    • 6% for the next R10 000.00;
    • 3% for the remainder of the amount
  1. The drawing fee according to Rule 33 of the Magistrates Court in the following Bills of Cost are:
    • Party and Party Bill of Cost = 11% drawing fee
    • Attorney and Client Bill of Cost = 11% drawing fee
  1. The attendance fee according to Rule 33 of the Magistrates Court in both the Party and Party as well as the Attorney and Client Bills of Cost are as follows:
    • 11% for the first R10 000.00;
    • 6% for the next R10 000.00;
    • 3% for the remainder of the amount
  1. With the Attorney and Own Client Bill of Cost our drawing fee will work on the following basis:
    • Matters of R0.00 to above R1 000 000.00 will be drafted on an 7% drawing fee if the matter is not taxed.
    • In the case that a Court Order is made with regards to attorney and own client costs, the bill of cost will be drafted and taxed according to the attorney and client fees as stipulated above.
  1. If a Bill of Cost is to be opposed, we will charge 11% of the amount that is saved.
  1. If a Bill of Cost is to be settled we will charge the prescribed fees as stipulated above, but no attendance fee will be charged unless the matter is settled 2 days before the taxation date, then attendance fees will be charged.
  1. The Rules of Court state that an inspection can be done on an Opponent’s file. In order for us to attend to an inspection a fee of R850 per hour will be charged plus travelling disbursements if any.

  1. Drawing and taxing of a party and party bill of costin litigious matters, Road Accident Fund matters, medical negligence matters and arbitration matters:

 

  • Drawing Fees in High Court matters – 11% drawing fee as stipulated in Rule 70 of the High Court.
  • Attending to Taxations in High Court matters – there is a prescribed method as set out in the rules and it is applied as follows – 11% for the first R10 000.00, then 5.10% for the next R10 000.00 and finally 2.12% for the remainder of the amount as stipulated on the allocator and as set out in the rules.
  • Drawing Fees – Magistrate Court matters – 5% drawing fee as stipulated in the Magistrate Court Rules.
  • Attending Taxations – Magistrate Court matters – 5% attendance fee as stipulated in the Magistrate Court Rules.

 

  1. Drawing and taxing of attorney and client bills of costin litigious matters, Road Accident Fund matters, medical negligence matters and arbitration matters.

Take into account that with a court order stipulating that the winning party is entitled to cost on the scale of attorney and client, a surcharge may be added, and the discretion of the taxing master will be used with regards to reasonableness during taxation of the matter.

 

  1. Drawing of attorney and own client bills of costin litigious matters, Road Accident Fund matters, medical negligence matters and arbitration matters.

 

Our firm has decided to work according to scales for our Clients and it will thus be explained as follows:

 

Scale 1 is applicable on matters ranging between R0.00 – R200 000.00:
Drawing fees will only be 7% of the total fees.

Scale 2 is applicable on matters ranging between R200 001.00 – R500 000.00:
Drawing fees will only be 6% of the total fees.

Scale 3 is applicable on matters ranging between R500 001.00 – R1 000 000.00:
Drawing fees will only be 5% of the total fees.

Scale 4 is applicable on matters ranging between R1 000 001.00 – and above:
Drawing fees will only be 4% of the total fees.

 

In the case that a Court Order is made with regards to attorney and own client costs, the bill of cost will be drafted and taxed according to the attorney and client fees as stipulated above.

 

  1. Opposing Bills of Costour fee is 11% of the amount that is saved plus our attendance fee according to the set prescribed rules.

 

  1. Settling Bills of Cost we charge the normal drawing fee as the set out in the prescribed rules, but no attendance fee will be applicable.

 

  1. Inspections– According to the Court Rules you are entitled to inspect the file of the Opponent and therefore if we need to attend to an inspection the fee will be 00 per hour.

 

  1. If any other matter is brought under our attention, we will draft the bill of cost according to the set prescribed rules as provided.
